When Is a Civil Injunction Used to Stop Construction or Activities?

Civil injunction basically court ka written order hota hai jo kisi party ko kuch karne ya na karne ka direction deta hai. Illegal construction, encroachment, nuisance, trespass jaise matters me injunction sabse powerful remedy hoti hai.

Agar aap dekh rahe ho ki neighbour aapki land pe boundary cross karke wall bana raha hai, ya builder sanctioned plan ke against extra floors khada kar raha hai, to aap suit for injunction file kar sakte ho. Court se request hoti hai ki “status quo maintain karo” ya “construction rok do”.

Normally pehle temporary / interim injunction ke liye application file hoti hai (Order 39 Rules 1 & 2 CPC type). Court dekhti hai –

  • Prima facie case hai?
  • Balance of convenience kis ke favour me hai?
  • Irreparable injury hogi kya agar injunction na mile?

Agar judge satisfy ho gaya to ad-interim stay mil sakta hai, jisse saamne wala kaam rokne ko majboor ho jata hai. Baad me evidence ke baad permanent injunction decide hota hai.

Injunction time-sensitive remedy hai. Delay se court kehte hain “you slept on your rights”, isliye illegal activity dekhte hi prompt action lena zyada effective hota hai.
