Law me offences ko broadly bailable aur non-bailable categories me divide kiya gaya hai. Naam se lagta hai ki non-bailable ka matlab “bail mil hi nahi sakti”, lekin practical reality thodi different hai.
Bailable offence me, accused ko bail as a matter of right milti hai – police station ya magistrate court dono jagah. Jaise simple hurt, minor scuffles, kuch types ke small offences. Yaha conditions simple hoti hain: bond, surety, address verification, etc.
Non-bailable offence me bail automatic nahi hoti. Court ko dekhna padta hai – offence ki gravity, evidence, accused ka background, flight risk, tampering chances, victim safety, etc. Murder, rape, serious economic offences, larger cheating cases typically is category me aate hain.
Non-bailable ka matlab “bail impossible” nahi; sirf criteria tighten ho jata hai. Accused ko competent court ke samne proper bail application move karni hoti hai, aur prosecution ko bhi suna jata hai.
Category samajhne se aapko idea mil jata hai ki arrest ke baad kya process, kya possibility aur kya strategy ho sakti hai.
