Probation Period in Jobs: What Legal Rights Does an Employee Have?

Job offer letters me often likha hota hai “probation period 3/6 months” etc. Iska idea hai ki employer employee ko closely observe kare aur fit na lage to easily let go kar sake. Lekin iska matlab yeh nahi ki probationer ke koi rights hi nahi hote.

Generally, probationer ko basic labour law protections milte hain – wages on time, safe workplace, no unlawful discrimination, etc. Termination thoda easier hota hai (shorter notice), but completely arbitrary, mala fide ya discriminatory termination courts me challenge ho sakta hai.

Important cheez ye bhi hai ki confirmation automatic nahi hoti jab tak letter ya policy me clearly mention na ho. Kayi companies probation extend kar deti hain, jisme transparency and reasons reasonable hone chahiye.

Employee ke liye smart step hai ki:

  • Appointment letter ki terms clearly samjhe,
  • Notice period, termination clause, probation extension rules padhe,
  • Performance feedback written form me occasionally le, taki future dispute me record ho.

Probation ka matlab “at-will slave” nahi, bas legally thoda flexible employment phase hai.
