Parents ke marne ke baad kaafi baar siblings jointly ancestral/self-acquired property ke legal heirs ban jate hain. Jab ek ya do log partition ke favour me ho aur koi ek strongly oppose kare, tab friction shuru hota hai.
Pehla step usually mutual settlement try karna hota hai – family meeting, mediator relative, ya lawyer-assisted negotiation. Agar consensus possible na ho, to partition suit civil court me file ki ja sakti hai. Court shares determine karke property ka metes-and-bounds partition ya sale + money distribution order kar sakta hai.
Agar property convenient tariqe se physical divide nahi ho sakti (jaise chhota flat), to one heir others ka share buy kar sakta hai, ya property market me sell karke proceeds proportionate shares me distribute ho sakte hain.
Important point: koi bhi ek co-owner without consent puri property kisi third party ko validly sell nahi kar sakta – wo sirf apna undivided share hi transfer kar sakta hai. Baaki co-owners ke paas legal defences rehte hain.
Delay sirf bitterness badhata hai; time pe clean partition long-term relations bachata hai.
