School ya college se unfair expulsion ek student ki life pe direct effect daal sakta hai – academics, career, mental health sab disturb ho jata hai. Isliye law expect karta hai ki institutions fair procedure follow karein.
Basic principle: natural justice. Matlab student ko allegation ka clear notice mile, apni side explain karne ka mauka mile, aur decision bias-free ho. Sirf oral gossip ya personal grudges pe tanav me aakar expel kar dena legally defensible nahi hota.
Agar disciplinary action lena ho, to institution ko apni rules/handbook ke hisaab se enquiry karni chahiye, witness examine karne chahiye, aur student ko representation ka chance dena chahiye. Final order reasoned hona chahiye – “kyun” explain kiya gaya ho.
Student ya parents pehle internal appeal, grievance cell, management, ya university authorities ko approach kar sakte hain. Agar fir bhi injustice lage, High Court me writ petition file ki ja sakti hai.
Point simple hai: discipline allowed hai, lekin arbitrary expulsion nahi.
